These Terms and Conditions govern your use of divva.ae (the "Site"), owned and operated by Divva ("we", "us", or "the Company"). By accessing or using the Site, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, please discontinue use of the Site immediately.

We reserve the right to update these Terms and Conditions at any time. Changes take effect upon posting to the Site. Your continued use of the Site following any changes constitutes your acceptance of the updated Terms and Conditions. We recommend checking this page periodically.


1. Eligibility

You must be at least 18 years of age to register an account or make any purchase on this Site. By using the Site, you confirm that you meet this requirement. If you are under 18, you are not permitted to register, transact, or use this Site in any capacity.


2. Use of the Site

We grant you a limited, non-transferable, and revocable license to access and use the Site solely for the purpose of personal shopping. This license does not extend to:

4. Permitted Use & Intellectual Property

All content on this Site — including but not limited to text, graphics, images, software, audio, video, and their selection and arrangement — is the property of Divva and is protected under UAE copyright laws and applicable international conventions. All rights are reserved.

You may view and retain a copy of pages from this Site for your own personal, non-commercial use only. You may not reproduce, republish, distribute, or exploit any content from this Site without our prior written permission.

Cardholders are advised to retain a copy of all transaction records and to review our policies at the time of purchase.


5. User Submissions

Any content, feedback, questions, comments, or suggestions you submit to the Site ("Submissions") become the sole and exclusive property of Divva upon submission and will not be returned to you. By submitting, you confirm that:

  • Your Submission does not infringe on the rights of any third party
  • You are not impersonating any person or entity
  • Your Submission is not false, misleading, or unlawful

We reserve the right, but are not obligated, to edit or remove any Submission at our discretion.


6. Order Acceptance & Pricing

Placing an order on our Site constitutes an offer to purchase, not a confirmed sale. We reserve the right to refuse or cancel any order at any time for any reason, including but not limited to:

  • Pricing errors or inaccuracies displayed on the Site
  • Suspicion of fraudulent activity
  • Inability to verify your information
  • Product unavailability

In the event of a pricing error, we will either contact you for instructions or cancel your order and notify you accordingly. If your card has already been charged and the order is canceled, a full refund will be issued.


7. Accepted Payment Methods & Currency

All transactions on divva.ae are processed exclusively in UAE Dirhams (AED). We accept the following payment methods:

  • Visa (Credit & Debit)
  • Mastercard (Credit & Debit)

We do not accept any other currencies or payment methods at this time.


8. Restricted Territories

In compliance with the regulations of the Office of Foreign Assets Control (OFAC), Divva will not conduct business with, or provide services to, individuals or entities located in, or acting on behalf of, any OFAC-sanctioned country, or any individuals or groups designated under applicable OFAC programs, including but not limited to those involved in terrorism or narcotics trafficking.


9. Disclaimers & Limitation of Liability

The Site and its content are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. To the fullest extent permitted by applicable law, Divva expressly disclaims all warranties, including but not limited to:

  • Fitness for a particular purpose
  • Accuracy or completeness of content
  • Uninterrupted or error-free operation of the Site

In no event shall Divva, its directors, employees, or affiliates be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Site, even if advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount paid by you for the transaction giving rise to such claim.


10. Indemnification

You agree to indemnify, defend, and hold harmless Divva and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or relating to your use of the Site, your violation of these Terms and Conditions, or your violation of any rights of a third party.


11. Governing Law & Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of the Emirate of Dubai, United Arab Emirates, which is our country of domicile. Any disputes shall be subject to the exclusive jurisdiction of the courts of Dubai, and both parties waive any objection based on venue or inconvenient forum.


12. Arbitration

Any dispute, controversy, or claim arising out of or in connection with these Terms and Conditions shall be referred to and finally resolved by binding arbitration before a single arbitrator, conducted in English in Dubai, UAE. The arbitrator shall be legally trained with relevant experience and independent of both parties.

Notwithstanding the above, Divva reserves the right to seek injunctive or other equitable relief through the courts to protect its intellectual property rights or confidential information.


13. Termination

We reserve the right to suspend or terminate your access to the Site at any time, without prior notice, for any conduct that we determine, in our sole discretion, to be in violation of these Terms and Conditions or harmful to other users, us, or third parties. Upon termination, your right to use the Site ceases immediately.

If you are dissatisfied with the Site or any of our policies, your sole remedy is to discontinue use of the Site.
